InstaLingo Terms of Service

These Terms of Service ("Terms") are a legal agreement between you ("User") and InstaLingo ("we", "us") governing your use of https://instalingo.online and related services (collectively, the "Service").

By accessing or using the Service, you accept these Terms.

1. Eligibility

You must be at least 13 years old and capable of forming a binding contract. If you act on behalf of a company, you confirm authority to bind it.

2. Account Responsibilities

Provide accurate information and keep credentials secure. You are liable for activity under your account.

3. Subscriptions & Payments

  • Payments are handled by Creem, Inc. (Merchant‑of‑Record).
  • Prices are in USD and may include taxes collected by Creem.
  • Subscriptions renew automatically; cancel anytime before renewal.
  • First‑time purchases are eligible for a 7‑day refund; renewals are non‑refundable unless required by law.
  • We may adjust fees with 30 days' notice.

4. Acceptable Content & Conduct

You agree NOT to upload, generate or share content that:

  1. Is pornographic, sexually explicit or exploits minors;
  2. Depicts extreme violence, self‑harm, or hateful content;
  3. Infringes copyright or trademarks;
  4. Contains personal data of others without consent;
  5. Promotes illegal activity or malware;
  6. Violates Creem's prohibited‑product policy.

We may employ automated and manual moderation. Violations may result in content removal, account suspension or referral to authorities.

5. Licence

5.1 Our IP

We retain all rights to the Service. We grant you a revocable, non‑exclusive licence to use it.

5.2 Your Uploads

You own your uploaded images. You grant us a limited licence to process them solely to provide the Service.

5.3 Generated Output

Generated captions & hashtags belong to you. We may use them (anonymised) to improve algorithms.

6. Termination

We may suspend or terminate your account for breach, illegal conduct, or risk. Outstanding fees remain payable.

7. Disclaimer

Service is provided "AS IS". We do not guarantee specific engagement results.

8. Limitation of Liability

Our aggregate liability is limited to the fees you paid in the previous 12 months. We are not liable for consequential damages.

9. Indemnity

You will indemnify us against claims arising from your content, conduct or breach of these Terms.

10. Governing Law

These Terms are governed by the laws of Hong Kong SAR. Courts of Hong Kong have exclusive jurisdiction, except mandatory consumer rights.

11. Modifications

We may revise Terms with at least 7 days' notice. Continued use constitutes acceptance.
